TERMS OF SERVICE FOR CUSTOMERS

Paper Studio Pty Ltd

ABN 93 662 667 307  |  hello@paperstudio.store  |  paperstudio.store

Hello and welcome to Paper Studio. We're so happy to have you as a customer. These are our Terms of Service ("Terms") which apply to all customers of Paper Studio Pty Ltd (ABN 93 662 667 307) ("we", "us", "our"). By using our Website and purchasing our Products, you're agreeing to these Terms together with any other terms and conditions and policies we publish or link to (together, the "Agreement"). If you do not agree, unfortunately you won't be able to purchase our Products online.

1. BEFORE PURCHASE

1.1 Things you need to know before purchasing

Before you buy anything from our Website, there are a few things you should know:

  • you need to be at least 18 years old to purchase from us; if you are under 18, you may only place an order with the involvement and consent of a parent or guardian, who will be responsible for the order;

  • our Website and Products are not directed at children, and we ask that anyone under 18 does not provide us with personal information without the involvement of a parent or guardian;

  • please give us complete and accurate information, and let us know if anything changes;

  • you need to use any special offers, gift codes or coupons at the time of purchase - they cannot be applied after the fact; and

  • once you place an order, we may not be able to cancel it, as your order will have already been sent to our print-on-demand fulfilment partner for processing.

1.2 Important acknowledgements

Whilst we aim to do our best, please be aware that there could be:

  • occasional errors or omissions in Product descriptions, prices, shipping charges, delivery times, availability and promotions;

  • colour differences, so that the colours and images of Products we display may appear different on your screen compared to the actual Products; and

  • some Products with limited quantities, and some sales that are limited to certain regions or groups of people.

Except as required by law, we cannot guarantee the accuracy of the information, the colours and images, or the availability of Products.

2. PRINT-ON-DEMAND PRODUCTS

2.1 How our Products are made and shipped

All of our Products — including personalised notebooks, journals, wrapping paper, notepads and other stationery — are printed on demand and are unique to each customer. Your order is fulfilled by a third-party printer who sources the blank materials. Print locations are situated in different areas around the world, and your order will be printed and shipped from the location closest to you in order to minimise delivery time and costs.

Because each Product is made especially for you, we ask that you carefully check your personalisation details before placing your order. We are not able to accept returns or provide refunds for Products where the personalisation details you provided were incorrect.

2.2 Your personalisation content

When you place an order, you may provide us with text, images, designs, artwork or other content to personalise your Product (“Your Content”). You grant us, and our fulfilment partners, a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, adapt and print Your Content for the purpose of fulfilling your order. You warrant that you own, or have all necessary rights and permissions to use, Your Content, and that our use of Your Content to fulfil your order will not infringe the intellectual property or other rights of any third party. You agree to indemnify us and keep us indemnified from any Claim arising out of or in connection with Your Content, including any Claim that Your Content infringes the rights of a third party.

Please do not upload any sensitive information, or any personal information about another person, unless you have that person’s consent to provide it to us for the purpose of fulfilling your order.

2.3 Delivery

Delivery times will depend on your location and the delivery option selected at checkout. Because our Products are printed on demand and shipped from our global network of fulfilment partners, estimated delivery times will vary. International customers are responsible for any customs and import duties that may be payable on delivery.

If you have issues with late, stolen or damaged deliveries, please contact us and we will assist you in liaising with the relevant courier company. Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law, including your right to receive Products within a reasonable time.

3. AFTER PURCHASE

3.1 Things to know after purchasing

After purchasing from our Website:

  • if you have issues with late, stolen or damaged deliveries, please contact us and we will help you liaise with the relevant courier company;

  • please follow our instructions and any manufacturer's instructions in relation to the Product;

  • if you have any issues with your Product, please contact us at hello@paperstudio.store as soon as possible after receiving your order (ideally within 48 hours); this timeframe does not limit your rights under the Australian Consumer Law, which apply for a reasonable time depending on the Product;

  • please obtain our prior written consent before publishing any information about us; and

  • if there is a dispute, please keep all communications confidential.

3.2 Sharing your experience

We love hearing from our customers and seeing their experiences with our Products! If you have any photos, videos, testimonials or case studies, we'd be thrilled if you would share them with us. We might use them for marketing and informational purposes, publications, exhibitions and professional awards across print and digital mediums, including our social media channels.

Please note that by providing us with photos, videos, testimonials and/or case studies, you grant us a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to use, reproduce, adapt, publish and communicate that content for our marketing, informational, publication, exhibition and professional awards purposes across print and digital mediums, including our social media channels. You retain ownership of the copyright in that content. If you provide content but do not want us to use it, please notify us immediately at hello@paperstudio.store.

4. CONSUMER RIGHTS AND REFUNDS

4.1 Australian Consumer Law

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Except as required by law, we do not provide refunds for:

  • change of mind;

  • where a problem with the Product is due to your misuse;

  • failure to comply with our instructions;

  • where you fail to take reasonable care; or

  • where you provided us with incorrect personalisation details.

4.2 Order cancellations by us

On occasion we may need to cancel an order where we are unable to fulfil it. In those circumstances, we will provide you with a full refund. Where we cannot fulfil part of your order, we will contact you and ask whether you would like a replacement, substitution or refund.

Acting reasonably, we may refuse, limit or cancel any order for our Products, including where we are unable to fulfil the order, where an order appears to be placed by a reseller or distributor without our permission, or where we reasonably suspect fraud or a breach of this Agreement. If we cancel an order you have already paid for, we will provide you with a full refund.

5. CHANGES TO WEBSITE AND SERVICES

Except as required by law, we may change shipping information, availability, Product information, prices, promotions and any other information on our Website, and may make changes to or stop providing our Website and Services, acting reasonably and, where practicable, on reasonable notice. We may suspend or terminate your access to our Website and Services whereyou breach this Agreement or where reasonably necessary to protect our legitimate business interests. Any such change will not affect an order we have already accepted from you.

6. LIABILITY AND INDEMNITY

To the maximum extent permitted by law, we are not liable for any Loss or Damage arising from your use of our Website and Services or any Products purchased through our Website, including but not limited to any errors or omissions, price changes or discontinued Products, lost or stolen Products during delivery, any late delivery, your reliance on any of our information, any links to third-party websites, any interruptions, changes, suspension or termination of our Website and Services, or your use or misuse of any Product.

To the extent which we are entitled to do so under the Australian Consumer Law, our liability will be limited, at our option, to:

  • the replacement of the Products or the supply of equivalent products; or

  • the payment of the cost of replacing the Products or of acquiring equivalent products.

In any case, our liability to you will not exceed the amount actually paid by you to us for the most recent Product you purchased.

You agree to indemnify us and keep us indemnified from any Claim arising out of or in connection with your breach of this Agreement.

7. FORCE MAJEURE

Where a Force Majeure Event occurs, we will not be considered to be in breach of this Agreement to the extent that our obligations are unable to be performed by reason of such event. We will not incur any liability to you for any Loss or Damage of any nature incurred or suffered in connection with a Force Majeure Event.

8. DISPUTE RESOLUTION

In the event of any dispute that cannot be resolved directly between us, both parties agree to engage an independent professional arbitrator or dispute resolution specialist to make a determination, and each party agrees to pay their own costs. Nothing in this clause prevents either party from seeking urgent relief from a court, or limits or excludes your right to bring or pursue a claim before any court or tribunal of competent jurisdiction, including in respect of your rights under the Australian Consumer Law.

9. GENERAL

This Agreement is governed by the laws of New South Wales, Australia, and you and we submit to the jurisdiction of the courts of New South Wales, Australia. This is the entire agreement between you and us and supersedes any prior agreements, proposals and communications, whether oral or written. No other term is to be included in this Agreement except where required by law. Our failure to exercise any right or enforce any provision in this Agreement does not waive the future operation of that right or provision. If any provision in this Agreement is not enforceable, it will be severed to the extent permitted by law and the remaining provisions will remain in full force and effect. All obligations and liabilities in this Agreement survive termination.
